Link School Online Terms and Conditions 

Welcome to Link School Online (the ‘Platform’ or the ‘Service’). These terms and conditions outline the rules and regulations for the use of the Link School Online website.

Link School Online is a brand which belongs to Link School Ltd (Link School of English in London) based at Ealing House, 33 Hanger Lane, London, W5 3HJ, UK; company registration number: 7293635, registered in England.

General Rules 


By creating an account, accessing or using any part of the Service, you confirm that you have read, understood, and agree to these Terms and Conditions including any future modifications. If you do not agree to abide by these Terms and Conditions stated on this page, you are not authorized to use, access or participate in the Service and should stop using the Service immediately. 

Link School Online reserves the right to amend, update or change these Terms and Conditions.

By using the Service users can use a variety of educational services, including learning or practicing a language or other subjects. Link School Online may, in its sole discretion and at any time, update, change or make improvements to any aspect of the Service, temporarily or permanently.

Students under the age of 18 shall obtain consent from their legal representative, such as a parent or guardian, to use the Service. The minimum age of Link School Online students is 16. 

No person who is not a party to the Link School Online Service shall have the right to enforce any term of these conditions.

These conditions supersede all previous terms issued by Link School Online.

Registration and Subscriptions

When registering for the Service, you agree to provide accurate and complete information about you, to accept all our Terms and Conditions, to obey our Code of Conduct and to be fully responsible for any actions that take place through your account. At registration the Student must enter an active email address and a personal password to be able to have access to the Service. The Student is obliged to inform Link School Online of any changes in their personal details.

If you purchase a subscription and choose an auto-renewing periodic subscription option, your Link School Online account will be billed continuously for the subscription until you terminate it. If you do not wish your subscription to renew automatically, or if you want to change or terminate your subscription, you will need to log in to your Link School Online account and update your subscription preferences. 

After submitting an order to us, you will be sent an order acknowledgement by email with your order reference and details of the services you have ordered.

All orders placed by you are subject to acceptance by us. We may choose not to accept your order for any reason and will not be liable to you or to anyone else in those circumstances.

Prices and payment

The prices of Services advertised for sale on our Platform are as set out on our Platform. All prices are in pounds (£) sterling, inclusive of VAT. 

Prices may change at any time prior to (but not after) acceptance of your order. We may run special offers, time limited offers or local promotions which may not be available in all locations. 

Your order will be complete only after you have paid for it in full. We work on first-paid-first-served basis.

Personal Data

Link School Online shall use registered information collected from users only for the purposes of providing the Service. We will never sell your personal data. We will not share your personal data with third parties without your consent unless ordered to disclose information by law. 

Link School Online may record and save comments, conversations, inquiries, and posted information within the Service as reasonably required for the purpose of delivering and managing the Service; and if deemed necessary, Link School Online may also collect and store images, videos and audio files. We will use this information to the minimum extent possible, and only for unavoidable reasons encountered as part of the suitable service delivery. Users are deemed to have agreed to Link School Online storing and using this information. 

 

We may collect and process the following data about you:

  • details of transactions you carry out through the Platform and the fulfilment of your orders;
  • information that you provide by filling in forms on our Platform, including but not limited to, information provided at the time of registering a user account, subscribing to any service, posting material or requesting further services. We may also ask you for information when you enter a competition or promotion sponsored by us;
  • information from surveys that we use for research purposes, if you choose to respond to them;
  • communications you send to us, for example to report a problem with or submit a comment regarding our Platform;
  • details of your visits to our Platform, including, but not limited to, course progress, test results, traffic data, location data, weblogs and other communication data. 

Payment Services 

Link School Online uses third party payment services to bill you through an online account payments in lieu of directly processing your credit or debit card information. All transactions are secured as our payment providers use SSL encryption protection. All payment information is encrypted and stored securely by our payment processing providers. We do not collect, store or otherwise process your billing or payment information. You agree that Link School Online will not be responsible for any failures of the third party to adequately protect such information. 

Licence to Use the Service

Link School Online grants the Student a right of use, or license, rather than a sale, for the use of the Service through the Link School Online website. Link School Online reserves any other rights that it does not expressly grant.

The Licence to use the Service through the Platform is a non-transferable licence for the use of said Platform on any compatible device owned or controlled by the Student. 

The Student cannot rent, lease, loan, sell, redistribute or sub-licence the content of the Service or any part of it. The Student may not copy, decompile, reverse engineer or disassemble the content for the Service, attempt to derive the source code thereof, or modify or create derivative works from the content of the Service.  

Any attempt to do so will constitute an infringement of the rights of Link School Online. 

Delivery of Live Lessons

Link School Online accepts no responsibility for technical issues on the Student’s side and loss of lessons due to those issues. 

If the Student does not respond (including any circumstances that prevent them from being able to communicate) within 15 minutes from the start of the lesson we may consider the Student to have missed the lesson, and therefore terminate the lesson accordingly.

If the Student repeatedly misses their lessons without any prior permission, Link School Online may send the Student warnings, requests for improvement, or other similar notifications. 

Missed lessons cannot be made up for or refunded for regardless of the reasons.

Link School Online may cancel or re-schedule a lesson if the teacher assigned is unable to give the lesson or due to other unavoidable reasons. The Student will be compensated with the same lesson duration (to be used within 6 months since the time of the cancelled lesson) or may request a refund for the cancelled lesson. 

Link School Online guarantees to deliver the number of course hours paid for.

Course Level Allocation for Group Lessons

All students participating in group lessons are asked to complete our English level test. The level test must be completed within the time limit and without any aids. Link School does not accept any responsibility for inaccuracy of placement tests taken online.

Link School does not guarantee a place in the group registered for if the placement test result does not reflect student’s actual language ability or the student’s progress throughout the course is significantly different than his course group.

Group and level allocation of students is at the school’s discretion.

In exceptional circumstances Link School Online reserves the right to merge classes to maintain continuity of learning. If there is only one student booked on a course or the student’s language ability doesn’t match the group level, Link School Online reserves the right to move the student to a different course group or convert the group booking into a value equivalent of private classes. This decision is strictly at the discretion of the Link School Online Management.

Health Declaration

If you have any disability, learning difficulties or special educational needs, this must be reported to the Service provider at the time of booking.

Service Date and Time Displays

In the Service, dates and times such as the membership or course start date, lesson times, deadlines for various payments, etc., are all displayed based on London time (GMT). 

Cancellations and Refund Policy

You may cancel your order within 14 days from the date of your order and you must do it in writing. If you book live lesson within our Service, you can cancel your order up to 14 days before the first lesson booked. If you place an order less than 14 days before the first lesson, you lose the right to cancel. 

Refunds are processed within 30 days.

You may not cancel your order if:

  • you have started to download or stream
  • you have started the course
  • you couldn’t use your course because you have lost your login details, had no internet access or any other technical issues on your side 
  • the Services have been customised or made to your own specifications

unless such Services were damaged or faulty when delivered to you or have been incorrectly delivered.

In the event your Link School Online user account is suspended or terminated or you close your account voluntarily, you understand and agree that you will receive no refund. 

Link School Online is not responsible for any fees charged by payment systems and will not cover such fees when issuing a refund. 

It is not possible to transfer the booking to another person.

If you ordered our Service but cannot participate in an online course, you may be able to have your purchase price held on your account for a future course within 6 months of purchase. Link School Online does not guarantee future availability of the services originally booked and reserves the right to change times of online live lessons or modify the content of the Service. 

If you would like to keep your payment on hold you must notify our Customer Service by email not later than 7 days before your first lesson. If you fail to notify us at least 7 days before the first lesson you will not be able to change your booking and will have no right to refund for unattended lessons. 

Limitation of Liability

Link School Online shall not be liable to you or any third party for indirect, special, incidental, consequential or exemplary damages relating to the use or inability to use the Service or any part of the Service including but not limited to the loss of use of the Service, loss of profits, business interruption, inaccurate results or damages related to loss or corruption of data, the cost of substitute services or claims for any damage to hardware, software or any other property. 

Link School Online liability is limited to the amount paid by you to Link School Online for the Service in the 12 months prior to the initial action giving rise to liability. 

Link School Online shall accept no responsibility for any damage or inconvenience caused to the users or third parties due to the suspension or termination of the Service with no fault attributable to the service provider.

Link School Online does not accept any responsibility for any misunderstandings caused by insufficient English knowledge of the Student or translations into other languages including the content of our Platform or any online or printed promotional materials published elsewhere. 

Every effort is made to keep the website up and running smoothly. However, Link School takes no responsibility for, and will not be liable for, the website being temporarily unavailable due to technical issues beyond our control. We reserve the right to modify this website without prior notice.

Responsibility of Link School Online for the Information Contained on the Platform

We make our best efforts to keep the Service in good working order, avoiding errors and keeping the content of the Service up to date. The Service and rights granted or provided to you by Link School Online are provided on ‘as is’ basis. While Link School Online endeavours to keep the information up to date and correct, we do not guarantee the completeness, accuracy, reliability, suitability or availability with respect to the website or the information, products, services, or related graphics and imagery contained on the website for any purpose. Link School Online or its providers make no representations or warranties of any kind with respect to the Service, either express or implied, and all such representations and warranties, including warranties or merchantability, fitness for a particular purpose or non-infringement, are expressly disclaimed. 

Link School Online does not make any representations or warranty of any kind relating but not limited to service availability, accuracy, completeness, error-free operation, informational content, results to be obtained from use of the Service or non-infringement. The Service may be unavailable during peak demand, system maintenance or other reasons. 

Content of the Service

The Student undertakes not to use the content that is available at any time on the Platform in any way that may represent a breach of any regulations, or may be contrary to common morals and decency, or the image and good professional name of Link School Online or its partners.

Where our Platform contains links to other websites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those websites or resources and we accept no responsibility for content of any other websites. 

Intellectual Property

All content on our Platform including but not limited to text, software, photographs and graphics is protected by copyright. Link School Online, or our licensors, own copyright of their content. 

You shall not assert or attempt to obtain any such rights and you shall not use, copy, reproduce, modify, publish, transmit, participate in the transfer or sale of, create derivative works from, or in any way exploit, our name, trade marks, logos or other proprietary marks, or any of the content of our Platform, in whole or in part.

If you provide any content to our Platform (for example, by providing ratings and reviews, comments, articles or uploading any other content in any format (including video) you agree to grant us permission, irrevocably and free of charge, to use your content, including adapting it for operational or editorial reasons, in any media worldwide, for our own marketing, research and promotional activities and our internal business purposes which may include providing content to social media and networking sites.

If you are a copyright owner and have a good faith belief that any material available through the Service infringes upon your copyrights, you may submit a copyright infringement notification to Link School Online pursuant to the Digital Millennium Copyright Act by providing us with the following information in writing:

  • an electronic or physical signature of the copyright owner or the person authorized to act on behalf of the owner of the copyright interest;
  • a description of the copyrighted work that you claim has been infringed;
  • a description of where the material that you claim is infringing is located on the Service, with enough detail that we may find it on the Service;
  • your address, telephone number, and email address;
  • a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
  • a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or are authorized to act on the copyright owner’s behalf.

User Responsibility 

You must ensure that your computer, mobile telephone or any other similar device which you use to access the Service is adequate for those purposes and, as a minimum, meets our specifications required for service access. We take no responsibility for any inability to access the Service resulting from faults or inadequacies inherent in the user’s own equipment.

You shall be responsible for protecting all information relating to your user account and for ensuring that no person gains access to your user account as a result of actions within your control. You are responsible for all actions taken through your account. 

You must follow our Code of Conduct. 

Complaints

Some problems and issues arise as a result of misunderstanding or mis-interpretation and we encourage students to approach us immediately when any problems arise. Complaints will be dealt with as quickly and as effectively as possible.

Complaints should be made immediately, while the student is still attending our courses and the school has a reasonable amount of time to take appropriate action.

Complaints must be made not later than within two weeks since the student became aware of the problem, not later than within a month after the course end date.

In an unlikely event of being unable to reach an agreement, Link School offers mediations through a third party professional mediator.

Termination

Link School Online may terminate your access and use of the Service immediately at any time and without any prior notice, if you violate any rules of the Service, exhibit any of the prohibited behaviours or for any other reason. At such time you will have no further right to use the Service. You may terminate your Link School Online account at any time. 

Governing law

Access to and use of the Service will be governed and interpreted in accordance with the law of England and Wales and the parties agree to the exclusive jurisdiction of the English Courts.
